447.3 - STUDENT SUSPENSION/EXPULSION
The School District of Auburndale delegates the responsibility for student discipline to the school administration. The school administration may provide guidelines in addition to, but not in conflict with the guidelines provided in this policy. Students may be suspended or expelled where warranted and in compliance with Wisconsin State Law.Student Suspension
1. A student may be suspended for not more than 5 school days in accordance with State Statutes. In the event that a notice of an expulsion hearing has also been sent, this period can be extended up to 15 school days.
2. The student will be given prompt notice of the suspension and the reason for the suspension. If the student is a minor, the parent or guardian will also be given prompt notice of the suspension and the reason for the suspension.
3. The student, parent, or guardian may have a conference with the district administrator or his/her designee within 5 school days following the commencement of the suspension, if they feel that the suspension was unjustified. Should it be determined by the district administrator or his/her designee that the suspension was unjustified, reference to the suspension shall be expunged from the student's record.
4. The suspended student shall not be denied the opportunity to take any quarterly, semester, or grading period examinations or to complete course work missed during the suspension period, as provided under s.118.16 (4)(a).
Student Expulsion Panel
1. The school board shall adopt a resolution authorizing an independent student expulsion hearing panel. The panel shall consist of 2 school board members or designees and the superintendent or his/her designee.
2. This panel authorization shall be effective for one year, but shall continue to be effective with the reaffirmation of this policy or adoption of a new authorizing resolution.
3. This panel shall be appointed by the school board and shall have the authority to expel a student from school when it finds that the student engaged in conduct that constitutes grounds for expulsion.
Student Expulsion
1. A student may be expelled from school after a panel hearing and in accordance with State Statutes.
2. An expulsion hearing will be scheduled and conducted by the authorized hearing panel.
3. A written notice of the hearing shall be sent not less than 5 days prior to the hearing. All legal criteria and particulars will be satisfied in the notice.
4. The expulsion hearing shall be properly recorded.
5. If the panel orders expulsion, a copy of the order shall be mailed to the student and the school board. If the student is a minor, a copy shall also be mailed to the student's parent or guardian.
6. Within 30 days of the order, the school board shall review the expulsion order and shall approve, reverse or modify the order.
7. A district decision for expulsion may be appealed to the State Superintendent of Public Instruction.
