342.11 - NONDISCRIMINATION ON THE BASIS OF HANDICAP - 504
Federal and state statues forbid discrimination against qualified disabled persons, including both students and staff members, by school districts receiving federal funds, regardless of whether the specific program of activity involved is a district recipient of federal funds.It is the policy of the Auburndale Board of Education to provide a free and appropriate public education to each disabled student within its jurisdiction, regardless of the nature or severity of the disability.
It is the intent of the School District of Auburndale to ensure that students who are disabled within the definition of Section 504 of the Rehabilitation Act of 1973 are identified, evaluated and provided with appropriate educational services.
Due process rights of disabled students and their parents under Section 504 will be enforced. The building principal will serve as the coordinator of Section 504 activities with the assistance of all other essential school personnel.
Under this policy, a disabled student is one who (a) has a physical or mental impairment that substantially limits one or more major life activities, including learning; (b) has a record of such an impairment, or (c) is regarded as having such an impairment (34 C.F.R. Section 104.3 (1) and (k). Students may be disabled under Section 504 and this policy even though they do not require services pursuant to the Individuals with Disabilities Education Act (IDEA).
To ensure compliance with federal and state statutes, the Auburndale School District will;
Prohibit discrimination solely on the basis of disability against qualified persons with disabilities in any aspect of employment.
Make facilities, programs, and activities accessible to persons with disabilities.
Ensure that students with disabilities will be identified, evaluated and provided with appropriate educational services.
Provide free appropriate education to disabled persons at elementary and secondary levels, including nonacademic and extracurricular services and activities.
Prohibit exclusion of any qualified disabled person solely on the basis of disability from participation in any educational program or activity.
Provide each disabled person with the same health, welfare and other social services as are provided other persons.
