411 - EQUAL EDUCATIONAL OPPORTUNITIES
The School District of Auburndale is committed to providing a quality education for all the children of the school district. Every pupil of the district will have equal access to equal educational opportunities. The School District of Auburndale shall not deny admission, accessibility to any student to participate in, or enjoy the benefits of, any program or activity on the basis of sex, race, ancestry, creed, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional or learning disability in the educational programs and shall not discriminate against any person on the basis of a student’s sex, race, religion, national origin, ancestry, creed, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional, or learning disability in the educational programs or activities which it operates.

The right of students to be admitted to school and to participate fully in curricular, extracurricular, student services, recreational or other programs or activities shall not be abridged or impaired because of a student’s sex, race, religion, national origin, ancestry, creed, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional, or learning disability.

Complaints regarding the interpretation or application of this policy shall be referred to the District Administrator, P.O. Box 139, Auburndale, Wisconsin 54412, for processing in accordance with established procedure.

COMPLAINT PROCEDURES

Any complaints regarding the interpretation or application of this policy shall be processed in accordance with the following grievance procedures:

INFORMAL PROCEDURE:

Any person who believes s/he has a valid basis for a complaint shall discuss the concern with the building principal if it is believed that the School District of Auburndale or any part of the school organization has inadequately applied the principles and/or regulations of Title VI, Title IX/PI-9 (118.13 Wis. Stats.) and Section 504 or in some way discriminates on the basis of sex, race, color, national origin, age, physical, mental, emotional, or learning disability. The principal will investigate the complaint and reply to the complainant in writing within three (3) business days. If this reply is not acceptable to the complainant, s/he may initiate a formal procedure according to the steps listed below.

FORMAL GRIEVANCE PROCEDURE:

1. Any student, parent, or resident of the district complaining of discrimination on the basis of sex, race, religion, national origin, ancestry, creed, pregnancy, marital or parental status, sexual orientation or physical, mental, emotional, or learning disability in school programs or activities shall report the complaint in writing to the District Administrator within five (5) business days of the receipt of the written reply to the informal complaint.

2. The District Administrator, upon receiving such a written complaint, shall immediately undertake an investigation of the suspected infraction. The District Administrator will review with the building principal, or other appropriate persons, the facts comprising the alleged discrimination. Within fifteen (15) school days after receiving the complaint, the District Administrator shall decide the merits of the case, determine the action to be taken, if any, and report in writing the finding and resolution of the case to the grievant.

3. If the grievant is dissatisfied with the decision of the District Administrator, s/he may appeal the decision in writing to the Board of Education. The Board shall hear the appeal at its next regular meeting or at a special meeting called for the purpose of hearing the appeal. The Board shall make its decision in writing within fifteen (15) days after the hearing. Copies of the written decision shall be mailed or delivered to the grievant and the District Administrator.

4. If the grievant is dissatisfied with the Board’s decision, s/he may appeal in writing within thirty (30) days to the State Superintendent of Public Instruction.

5. Discrimination complaints relating to the identification, evaluation, educational placement or the provision of free appropriate public education of a child with exceptional educational needs shall be processed in accordance with established appeal procedures outlined in the Special Education handbook.

6. Discrimination complaints relating to programs specifically governed by federal law or regulations shall be referred directly to the State Superintendent of Public Instruction.
